Terms of Service

1. Who we are

Fairworks (“we”, “us”, “the platform”) is a marketplace connecting customers (“Customers”) with independent service providers (“Pros”) for local services. By using the platform you agree to these Terms.

2. Marketplace, not employer

The platform is a marketplace. Pros are independent contractors operating their own businesses. The platform is not the employer of any Pro and does not perform the work itself. The platform does not warrant the quality, safety, or legality of any service performed by a Pro. Customers contract directly with Pros for the work.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract under Australian law to use the platform. Pros must hold any licence required for the service category in their state or territory.

4. Posting jobs and quotes

Customers post jobs describing the work needed. Pros may submit quotes. A booking is formed when a Customer accepts a quote and completes payment to escrow.

5. Payments and escrow

  • Customers pay the full booking amount upfront. Funds are held by the platform's payment processor (Stripe) on the platform balance — not transferred to the Pro until release.
  • Funds release to the Pro when the Customer confirms the work is complete, or automatically after the auto-release window (5 days from when the Pro marks the work complete) if the Customer hasn't confirmed or opened a dispute.
  • The platform deducts a platform fee from the booking total before transferring the remainder to the Pro. The fee percentage is shown to both parties before booking.

6. Disputes

Customers may open a dispute on a booking before funds release. Opening a dispute pauses the auto-release timer. Platform operators may resolve a dispute by issuing a full refund, releasing funds to the Pro, or splitting the booking between the parties. See the Refunds & Disputes page for the full process.

7. Conduct

You agree not to harass, defraud, or impersonate other users; not to post false or misleading information; and not to use the platform to facilitate any illegal activity. We may suspend or terminate accounts that breach this clause.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) that cannot be excluded by contract. Where permitted by law, our liability for breach of any non-excludable consumer guarantee is limited to re-supplying the relevant service or refunding the booking total.

9. Privacy

Your personal information is handled in accordance with our Privacy Policy.

10. Termination

Either party may terminate their account at any time. Outstanding bookings (with funds in escrow or open disputes) must be resolved before account closure.

11. Changes to these Terms

We may update these Terms to reflect changes in the service or legal requirements. Material changes will be notified by email at least 14 days before they take effect.

12. Governing law

These Terms are governed by the laws of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the Victorian courts.
